Nature of Proceedings: (1) Petition for Approval of First and Final Account etc. ; (2) Further Hearing re Final Distribution/ Report of Status of Administration of Estate(1) Petition for Approval of First and Final Account etc. The estate is not in a position to be closed since creditor's claims remain unpaid. The court will interpret this petition as a request to authorize a disbursement from the guardianship estate in the total amount of $20,000 to the decedent's estate. The personal representative may then use the funds to pay the creditor's claims. The remaining funds shall remain available to pay the costs of administration upon approval of the court. Once the creditor's claims have been paid and the estate is in a position to be closed, the personal representative must file an amended petition for approval of first and final account reflecting the income from the guardianship estate and payment of the creditor's claims. According to the current petition, the estate intends to distribute two vehicles to the minor. The amended petition for approval of the first and final account must justify why the guardianship needs two vehicles. It is recommended that this matter be continued to November 27, 2013 at 8:30 a.m. in Dept. 1 to review whether an amended petition has been filed. No appearance required on October 30, 2013. The personal representative is instructed to submit a proposed order to implement this ruling. The Judicial Council form MC-358 (Order for Withdrawal of Funds from Blocked Account) may be used. (2) Further Hearing re Final Distribution/ Report of Status of Administration of Estate Continue to November 27, 2013 at 8:30 a.m. to be heard concurrently with above.
