Nature of Proceedings: First Accounting and Report; Petition for Reduction of Bond

 

Appearance is required to address the following issues:

 

1) Conflict of interest raised by employment of Andrews, Galloway & Associates as the accountant for the conservatorship estate.

 

2) Attorney’s Fees are recommended to be reduced by $ 7,591.25 for the following:

 

  • Vague Entries that do not give an adequate description of the work: $3,201.75
  • Work performed on the Trust being charged to the Conservatorship: $973.50
  • Clerical work billed at $100 per hour, reduced to $25/hr appropriate rate: $277.50
  • Conservatorship Duties waived by Mr. Galloway, but performed by Attorney and his paralegal: $3,139
  • Overhead expenses: $404.74 – Postage and overnight mail / $38.86 – Delivery/pickup of documents 

 

3) Accountant’s Fees are recommended to be reduced by $ $24,506.25 for the following:

 

  • Services that could be categorized as conservator services: $8,092.75
  • Services related to correct an legally inadequate account: $7,087.50
  • "Quality control" entries that seem to be nothing more than review of the account: $9,326

 

 4) Bond Reduction

Co-conservators request that bond be reduced or dispensed with now that the bulk of the assets have been transferred to the trust. Based on the statutory formula, bond should be set at $86,263.14.
