Nature of Proceedings: Motion Withdraw as Attorney
Motion to withdraw as attorney. Ruling Granted. Analysis An attorney may withdraw without the consent of the client only by court order, upon application, and after notice to his client. Code Civ. Proc. § 284. Mr. Kallman has filed a proof of timely service of his motion on Plaintiff. An attorney may withdraw from a case when withdrawal can be accomplished without undue prejudice to the client’s interests. Ramirez v. Sturdevant (1994) 21 Cal.App.4th 904. Trial is set for January 26, 2010, and Lowe has not alleged any undue prejudice. Therefore, the Motion will be granted.
