Nature of Proceedings: Motion Compel Further Resp. Discovery/Evidentiary Sanctions

There has been considerable attention directed toward this file previously. It is now on 
calendar pursuant to Beverly’s motion (filed on 11/12/09) for an order compelling further 
responses to discovery, (2) for and order extending time for discover, or (3) for reopening 
discovery, or (4) for a new trial date, and (5) for issue or evidentiary sanctions. I have read 
the motion. 

Rene responded on 11/19. I have read the document. 

Beverly filed a reply on 11/20. I have read it. 

Rulings:

1. The trial date of December 8, 2009 will not be continued. Discovery will not be reopened 
provided that Beverly may take Renee’s deposition on or before December 8, 2009. 

2. The date and time will be agreed upon between counsel on or before November 24, 
2009, or the Court will simply select the date and place at the hearing.
  
3. No document demand will be made for the deposition. 

4. It will take no longer than 1 day. 

5. The motion to compel is otherwise denied.

6. There are no sanctions.
