Nature of Proceedings: Petition to Determine if Dog is Vicious

This is a Petition (filed on July 19) to Determine if “Milo” (a 3-year-old white and tan male Pit- Bull, license No. 8376) is a vicious dog. The dog was previously determined to be a potentially dangerous dog; attached is a declaration of Nene Jannke, with pictures; supports the claim that that on July 8, 2013, Milo attacked two other dogs. The Code Compliance Supervisor for the City of Carpinteria (Silva Echeverria) has submitted a declaration; reports that, based on Milo’s stray incident that occurred on April 25, 2013, and Milo’s attack on the two dogs that occurred on July 8, 2013, Milo is a threat to the public health, safety and welfare and that the dog should be removed from Daniel Jimenez’s ownership and be destroyed by the animal control department. A complete Notice of Hearing was filed on July 22; there is no response. Ruling: The Petition will be granted; bring an appropriate order.
